Megagon Labs, Inc. (Megagon, we, or us) offers the ASAPpy services to help connect diners with restaurants by providing diners with personalized restaurant recommendations and calling restaurants to make reservations on diners’ behalf using the ASAPpy AI assistant. This Privacy Policy describes how Megagon collects, uses, discloses, and otherwise processes information about you when you interact with the ASAPpy AI assistant, when you access or use the ASAPpy mobile application (the App) or website (collectively, the Services), and when you otherwise interact with us as it relates to the Services described in this Privacy Policy. We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). Collection of Information

The information we collect about you depends on how you interact with us. In this section, we describe the categories of information we collect and the sources of this information.

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information directly from you when you: create an account; search for restaurants and request and make reservations using our Services; fill out a survey; participate in a contest, sweepstakes, promotion, or referral program; sign up for marketing communications from us; talk to or otherwise interact with the ASAPpy AI assistant on behalf of a restaurant; request customer support; or otherwise communicate with us or interact with our Services. The types of information that we collect directly from you include:

  • Identifiers and Contact Information. We collect information from you directly, like your name or contact information, when you use or otherwise interact with our Services. For example, when you create an account on our App, we collect your name, state of residence, mobile phone number, and password.
  • Contest, Sweepstakes, Promotion, and Referral Contact Information: When you participate in a contest, sweepstakes, or promotion, we may collect information about you (such as your identifiers and contact information) to process and deliver entries and rewards.

We may also collect any other information that you choose to provide, such as when you contact us for customer support.

Information We Collect Automatically

We automatically collect information about your interactions with us or our Services, including:

  • Transactional Information: We keep a history of the reservations you make using our Services, including information about the restaurant and reservation, such as restaurant name and location, reservation date and time, party size, cuisine type, and post-visit survey results (if applicable).
  • Device, Usage, and Activity Information: We collect information about how you access our App and website, including data about the device and network you use (such as your hardware model, operating system version, mobile network, IP address, mobile device advertising identifiers, other unique device identifiers, browser type, and app version). We also collect information about your activity on our App and website, including the route by which you access our Services, access dates and times, app downloads and openings, use and browsing behavior (such as pages viewed, links clicked, and restaurant search and reservation activity, such as frequency, restaurant names, and cuisine type).
  • Audio Recordings and Transcripts: If you are a restaurant employee, when you participate in a call placed using our Services, we may record and transcribe the conversation for quality assurance, service improvement, and training purposes.
  • Precise Geolocation Information: With your consent, we will collect information about the precise location of your device when you use the App to search for nearby restaurants. We use this information to personalize your use of the App such as by providing you with personalized restaurant recommendations. You may stop the collection of precise location information at any time (see the Your Choices section below for details).
  • Information Collected by Cookies and Similar Tracking Technologies: We use tracking technologies, such as cookies, pixels, SDKs, and session replay, to collect information about your interactions with the Services and our marketing communications. These technologies help us improve our Services and marketing communications, personalize your experience, and analyze your interactions with us, including to see which areas and features of our Services are popular and count visits. Information We Collect from Other Sources

We obtain information from other sources. For example, we may collect information from analytics partners (such as data analytics providers), and third-party platforms (such as third-party restaurant listing and review sites and services). This information includes your contact information (such as your name) and user-generated content that you post (such as restaurant reviews and photos), device and usage information (such as IP address and inferred geolocation), demographic information (such as age and gender), occupation and household information, and inferences about your interests and preferences.

Information We Derive

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you may be interested in certain restaurants based on your past restaurant search and reservation history.

Use of Information

We use the information we collect to provide, maintain, and improve the Services, including to train and improve our models and recommendations engine that power the Services.

We also use the information we collect to:

  • Develop new products and services;
  • Personalize your experience with us;
  • Send you technical notices, security alerts, support messages, and other transactional or relationship messages;
  • Send you marketing communications (see the Your Choices section below for information about how to opt out of these communications at any time);
  • Monitor and analyze trends, usage, and activities in connection with the Services;
  • Generate de-identified or aggregate data that cannot reasonably used to identify you;
  • Facilitate contests, sweepstakes, and promotions and process and deliver entries and rewards;
  • Facilitate our referral program; and
  • Detect, investigate, respond to, prosecute, and help protect against security incidents and other malicious, deceptive, fraudulent, or illegal activity, and help protect the rights and property of Megagon and others, and comply with our legal and financial obligations.

Analytics

We engage others to provide analytics services and perform related services on our websites and App. To do this, Megagon and these service providers may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our Services, including your device identifiers, IP address, web browser and mobile network information, pages viewed, or time spent on pages or on the App. This information is used to analyze and track data, determine the popularity of content, and better understand user activity.

Disclosure of Information

We disclose information about you as described in the Analytics section above and in the following scenarios:

  • Restaurants. When you use our Services to contact restaurants to request a reservation, we will provide the restaurant certain categories of your information for the purposes of facilitating your request.
  • Vendors and Service Providers. We make information about you available to our vendors, service providers, contractors and consultants who perform services on our behalf, such as companies that assist us with web hosting, fraud prevention, incident response, customer service, analytics, advertising, and marketing.
  • Elements of the Services Offered by Third Parties. Certain aspects of the Services, such as the mapping of available restaurants, restaurant reviews, and our ability to search and recommend restaurants near you, are powered by third party services, including the Google Maps API(s). You can view Google’s privacy policy for more details about how Google processes personal data.
  • Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose personal information in response to a request for information if we believe that disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • To Protect the Rights of Megagon and Others. We may disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Megagon, our users, the public, or others.
  • Professional Advisors. We disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Corporate Transactions. We disclose personal information in connection with, or during negotiations of, certain corporate transactions, including a merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • With Your Consent or at Your Direction. We make personal information available to third parties when we have your consent or you intentionally direct us to do so.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you.

Data Retention

We store personal information associated with your account for as long as your account remains active and will delete personal information related to your account following 3 years of inactivity pursuant to our account data retention policy. We retain other personal information for as long as necessary to carry out the purposes for which we originally collected it and for other purposes described in this Privacy Policy.

International Transfers

Megagon is based in the United States, and we and our service providers process and store personal information on servers located in the United States and other countries. Whenever we make restricted international transfers of personal information, we take steps to ensure that your personal information receives an adequate level of protection (by putting in place appropriate safeguards, such as contractual clauses) or ensure that we can rely on an appropriate derogation under data protection laws.

Your Choices

Accessing, Correcting, and Deleting Information

You can access and correct certain information stored within your account on our App at any time by following the instructions behind the “Your Information” section of the “Profile” menu in the App. You may also contact us regarding requests to access, correct, or delete your account or other information using the details provided in the Contact Us section below.

Precise Location Information

When you first launch our App that collects precise location information, you will be asked to consent to the App’s collection of this information. If you initially consent to our collection of such location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device.

Cookies and Similar Tracking Technologies

Megagon uses cookies and similar tracking technologies, as described above. You can usually adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies and similar tracking technologies could affect some of the functionality of our Services.

Communications Preferences

You may opt out of receiving marketing messages from Megagon by following the instructions in those communications. If you opt out, we may still send you non-promotional messages to authenticate you during login, help you reset your password, and related to your support inquiries.

Mobile Push Notifications

With your permission, we may send push notifications to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
